Terms of Use (User Agreement)

1. Acceptance of Terms

By downloading, installing, or using the "Sivvy" mobile application (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a binding legal agreement between you and Sivvy Team ("we," "us," or "our").

2. Eligibility

You must be at least 17 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.

3. Description of Service

Sivvy is an AI Floral Expert tool that allows users to upload photos of plants to receive customized care schedules, environment analysis, and growth stage identification. The App includes features for care reminders and activity logging.

4. User Accounts

To access certain features, you may be required to create an account using your Name, Username, and Email. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. User Content and Conduct

5.1 User Content

You retain ownership of the photos and data ("User Content") you upload. However, by uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display such content solely for the purpose of providing the Services to you (e.g., analyzing the plant image).

5.2 Prohibited Conduct

You agree not to:

• Upload content that is illegal, offensive, or violates the rights of others.
• Use the App for any fraudulent or malicious purpose.
• Attempt to reverse engineer or compromise the security of the App.
• Use the App to generate advice for illicit plant cultivation.

6. AI Disclaimer and Limitation of Liability

6.1 AI Advisory Nature

The App uses Artificial Intelligence to identify plants and suggest care routines. While we strive for accuracy, AI is not infallible. The guidance provided by Sivvy is for informational purposes only and does not constitute professional botanical or agricultural advice.

6.2 No Guarantee of Results

We do not guarantee that following the App's advice will ensure the survival or health of your plants. Environmental factors vary, and we are not liable for the death or damage of any plants.

6.3 Limitation of Liability

To the fullest extent permitted by law, Sivvy Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data or goodwill, resulting from your use of the App.

7. Intellectual Property

The App, including its original content, features, and functionality (excluding User Content), is and will remain the exclusive property of Sivvy Team and its licensors.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of our primary place of business, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.
